Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of SparkySafe Pro (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. About the App
SparkySafe Pro is a professional tool designed to help electricians create, organise, and review electrical compliance and test reports, including photo evidence capture and optional AI-assisted analysis.
2. Eligibility and professional responsibility
- You must be able to form a binding contract under applicable law.
- You represent that you are using the App for legitimate trade or business purposes related to electrical work.
- You remain solely responsible for the accuracy, completeness, and regulatory compliance of any report, certificate, test result, declaration, or document produced with the App.
- The App does not replace licensed electrical judgement, applicable Australian Standards, or statutory certification requirements.
3. Licence to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use SparkySafe Pro on Apple devices you own or control, as permitted by the App Store Terms of Use.
You must not:
- Copy, modify, reverse engineer, or create derivative works of the App except as allowed by law;
- Rent, lease, sell, sublicense, or redistribute the App;
- Use the App to create misleading, fraudulent, or unlawful certificates or records;
- Interfere with the App’s operation or attempt unauthorised access to related systems or APIs.
4. Accounts and local data
The current App primarily stores report data on your device. You are responsible for safeguarding your device, backing up important records, and controlling who can access the App on that device.
5. AI-assisted features
Optional features may use Google Gemini or similar services to assist with OCR and safety analysis. AI outputs can be incomplete, incorrect, or inappropriate for a given job. You must independently verify all AI-generated suggestions before relying on them in any compliance, safety, or commercial decision.
6. User content
You retain ownership of content you enter into the App (including reports, photos, and signatures). You grant us a limited licence to process that content solely as needed to operate features you use (for example, on-device display/storage and third-party AI processing you initiate).
You confirm you have all rights and consents needed to upload or process client, site, and employee information through the App.
7. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
8. Fees and App Store purchases
Pricing, subscriptions, and purchases (if any) are handled through Apple’s App Store. Apple’s payment terms apply to billing, refunds, and cancellations for App Store transactions.
9. Disclaimer of warranties
The App is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that outputs will meet a particular regulatory or contractual requirement for your work.
Nothing in these Terms excludes guarantees that cannot be excluded under the Australian Consumer Law. Where liability cannot be excluded, it is limited to the maximum extent permitted by law (including resupply of services or payment of the cost of resupply, where applicable).
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, business opportunity, or regulatory penalties, arising out of or related to your use of the App.
Our total aggregate liability arising out of or relating to the App is limited to the greater of (a) the amount you paid for the App in the 12 months before the claim, or (b) AUD $50.
11. Indemnity
You agree to indemnify and hold harmless SparkySafe Pro and its operators from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, inaccurate reports, or breach of these Terms.
12. Third-party services
The App may depend on third-party services (including Apple platforms and Google Gemini). We are not responsible for third-party outages, policy changes, or terms that apply between you and those providers.
13. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate access if you breach these Terms or if continued operation becomes impractical for legal or technical reasons.
14. Changes
We may update these Terms periodically. Continued use after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date above shows the latest revision.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. Courts in that jurisdiction have non-exclusive jurisdiction, without limiting any non-excludable consumer rights you may have.
